the Devo guys are some smart fuckers, and they've been playing the game on their own terms for decades. plus, they're one of thee most original bands in all of pop music, so it's not the first time (nor the last) that someone will rip them off.

It's New Wave Nigel. I think it's referring to "XTCs - Making Plans for Nigel", isn't it? And the glasses of the figure strongly remind me to the 80's movie "mannequin" with Kim Catrall, anybody knows that one? There is one gay, black sidekick, wearing stupid glasses..
I think companys the size of McDonalds calculate before, if it would be cheaper to be sued or to buy the rights for trademarked things before. Which maybe wouldn't have been possible because Devo maybe would have probably denied it. So this way the could buy it against their will... That happens pretty often I think.
Or maybe they can't be sued, because some idiot at their outsourced PR-Agency came up with the idea for the figure, and he would have been responsible to check the legal usage of that hat-style before. Or some shit like that.

Mothersbaugh has made allot of music for childrens cartoons...Also Devo 2 is a good way to relay their message ... I got my first Devo Album at age 9, and I'm glad. Made a difference.
I mean.. Use your freedom of choice, they choose to get paid by both Disney and Mc Donalds..

I'm guessing that the idea came from their ad agency, and while I support Devo's case, the figures were probably thought up by someone who genuinely likes the band and thought this would be a good idea. Now McD's will just go back to some boring-ass Disney figures.

i dont know about that. my understanding of a civil suit is that if you lose you pay the other sides legal costs. could be wrong though. if mcdonalds was smart (which they are) theyll just pay devo whatever (im sure they arent asking for some absurd amount), discontinue the toy, apologize and move in. keep it out of the courts altogether.

These are the people that spent millions taking 2 penniless hippies to court in the UK for libel (in this case meaning 'unwelcome facts' lol) in the thought that eventually they'd crush them. They lost, big time, and yes McD had to pay all the costs.
I think Devo will win, because it's a clear trademark, and I also think they have enough $ to sue from their various deals with Disney etc.
And...good, McDonalds are fucking shite.

They are hardly washed up, they play better now.. Not to mention Josh Freese was playing drums for them on the last tour I saw.. Devo was the best show I have seen in awhile besides of WEEN in reno a few years back.
